We reserve the right to limit or prohibit orders that, in our reasonable judgment, appear to be placed by dealers, resellers, distributors, or individuals engaging in fraudulent or abusive purchasing or return practices.

We may also cancel, limit, or refuse orders containing inaccurate information, suspected unauthorized payment methods, unusual purchasing activity, pricing or inventory errors, or other circumstances that reasonably require additional verification.

Nothing in this section permits Elegance By Marislay to refuse service for any reason prohibited by applicable law.

4. Product Availability

All merchandise is subject to availability.

Adding an item to your shopping cart does not reserve or guarantee the availability of that item.

If we cancel an order or item because it is unavailable after payment has been processed, the applicable amount will be refunded to the original payment method.

8. Returns and Refunds

We want you to feel confident when shopping with Elegance By Marislay.

Eligible merchandise may be returned within 14 days of the confirmed delivery date, subject to the requirements, conditions, and exclusions contained in our Return & Refund Policy.

For eligible returns, customers may choose from the return options described in our Return & Refund Policy, which may include store credit or a refund to the original payment method.

When an Elegance By Marislay prepaid return label is provided for a refund to the original payment method, a $15 return shipping fee may be deducted from the eligible refund amount.

Approved store-credit returns may qualify for complimentary return shipping as described in our Return & Refund Policy.

Original shipping charges, if any, are non-refundable except where otherwise required by applicable law.

All returned merchandise is subject to inspection before a refund or store credit is approved.

The condition in which merchandise is received by Elegance By Marislay will be considered when determining whether the merchandise satisfies our published return requirements.

9. Return Condition Requirements

To qualify for a return, merchandise must satisfy all requirements contained in our Return & Refund Policy.

Among other requirements, merchandise must be unworn, unused, unwashed, unaltered, and returned with all applicable original tags and designated security/return tags fully attached, intact, and in their original placement.

Returned merchandise must be free from signs of wear or use, including but not limited to perfume, smoke, body odor, makeup, deodorant, tanning products, stains, pet hair, washing, dry cleaning, alterations, damage, or other markings or conditions inconsistent with merchandise that has only been carefully tried on.

Elegance By Marislay reserves the right to reject a return that does not satisfy our published return requirements, subject to applicable law.

If a return is rejected following inspection, we will contact the customer regarding the available options.

Please handle merchandise carefully while determining fit and do not remove applicable security/return tags until you have decided to keep the item.

10. Evening Wear and Formalwear

We understand that finding the correct fit is especially important when purchasing merchandise for a special occasion.

Eligible Evening Wear and Formalwear may be returned within the applicable return period when all requirements of our Return & Refund Policy are satisfied and the designated Elegance By Marislay security/return tag remains fully attached, intact, and in its original placement.

If the designated security/return tag is removed, cut, altered, replaced, reattached, substituted, or otherwise tampered with, the merchandise will be considered FINAL SALE and will not be eligible for return, refund, exchange, or store credit, except where otherwise required by applicable law.

Evening Wear and Formalwear showing evidence of wear, alteration, washing, dry cleaning, stains, odors, makeup, deodorant, stretching, damage, or other signs of use will not qualify for return under our standard Return & Refund Policy.

Customers should carefully try on these garments without removing or altering the designated security/return tag until they are certain they wish to keep the merchandise.

11. Final Sale Merchandise

Merchandise clearly designated FINAL SALE at the time of purchase is not eligible for return, refund, exchange, or store credit, except where otherwise required by applicable law.

Final Sale status may apply to certain clearance merchandise, promotional merchandise, or other products specifically identified as Final Sale before purchase.

Additionally, merchandise subject to a designated security/return tag may become Final Sale when that tag is removed or tampered with as expressly described in the applicable product information and our Return & Refund Policy.

Customers are responsible for reviewing the Final Sale designation and applicable product information before completing their purchase.

12. Damaged, Defective, or Incorrect Merchandise

We carefully inspect merchandise before shipment. However, if you receive an incorrect, damaged, or defective item, please contact us within 48 hours of confirmed delivery.

Please provide your order number and clear photographs showing the issue.

Do not return damaged, defective, or incorrect merchandise before contacting us and receiving instructions.

We will review the circumstances and provide an appropriate resolution in accordance with our policies and applicable law.
